The Site allows AXEPT to offer clothing items (hereinafter, the “Product(s)”) for sale to people browsing the Site (hereinafter, the “Customer(s)”).
The Site also allows the possibility of pre-ordering the Products. By placing a pre-order, the Customer acknowledges that, if the target for the number of pre-ordered items indicated in the information for each Product is not reached by the maximum pre-order date, the entire amount paid will be refunded and the pre-ordered Product will not be produced. Since production is limited, if the Customer purchases a Product available in stock, he accepts that he will not be able to change the size once received. If the Customer requests a refund for a pre-order or for an order of a Product in stock, the refund procedure will be initiated once the Product has been received by AXEPT. By placing a pre-order or an order (hereinafter, “Pre-Order” and “Order”) on the Site, the Customer confirms that he has read and unconditionally and irrevocably accepts these General Conditions of Sale (hereinafter, “CGV”). The Customer confirms that he has the capacity to conclude this contract, i.e. that he is an adult, i.e. eighteen (18) years old, and that he is not under legal guardianship. The parties agree that the relationship will be governed exclusively by these GCS.
AXEPT reserves the right to modify or make changes to these GCS at any time. The version of the GCS applicable to an Order or Pre-Order will be the one published on the Site on the day on which said Order or Pre-Order was placed.
These General Conditions of Sale (hereinafter, "the GSC") apply to all Orders and Pre-Orders placed on the website www.axeptofficial.com (hereinafter, "the Site") for the purchase of the Products made available on the said Site by AXEPT S.R.L., with registered office in Via Vincenzo Capelli, 6, 20124 Milan, registered in the Company Register of Milan with number 13616610963 and EU VAT number IT13616610963 (hereinafter, “AXEPT”).
By placing an Order or Pre-Order on the Site, the Customer confirms that he has read and accepts these GCS without reservation and irrevocably, aware that their acceptance does not require the physical signature of this document.
These General Conditions of Sale (CGV) regulate the purchase and sale of the Products offered on the Site by AXEPT to Customers. By placing an Order or Pre-Order, the Customer accepts these GCS and declares to have the legal capacity to enter into contracts.
In accordance with the Art. 49 of the Italian Consumer Code, AXEPT includes the characteristics of the Products on the Site. In this way, before placing their Order or Pre-Order, Customers can know the main characteristics of the Product(s) they wish to purchase.
The products in stock on the Site will only be available while stocks last.
Pre-order products on the Site must be pre-ordered by the date indicated and are limited to the number of items that will be produced. The images of the Products are for illustrative purposes only and have no contractual value.
The prices indicated on the Site are expressed in euros and include VAT. They are valid only on the day on which the Order or Pre-Order is placed by the Customer. AXEPT reserves the right to change these prices at any time and without notice. However, the Customer will be charged the price in force at the time of the Order or Pre-Order.
Prices do not include shipping costs, which are charged separately. These costs are specified before confirming the Order or Pre-Order. Prices include VAT at the rate applicable on the date of the Order or Pre-Order; any change in the VAT rate will be automatically reflected in the price of the Products on the Site. Orders and Pre-Orders must be paid in full at the time of purchase. Under no circumstances can the sums paid be considered as advance payments.
The prices of Products shipped outside the European Union will be free of VAT. In such cases, the Customer is considered the importer of the Products. Any customs duties, import taxes or other taxes applicable based on the geographical destination of the Products are the responsibility of the Customer. The Customer is therefore advised to verify and complete the necessary formalities before placing an Order or Pre-Order.
The Products must be paid for in euros on the day the Order or Pre-Order is placed. The accepted payment method is credit or debit card payment.
To pay by card, the Customer must enter the card number, expiration date and CVV code. To ensure the security of online payments, the Customer is redirected to a payment platform provided by Stripe, which ensures the security of data and transactions. The Customer, by providing the card number to AXEPT via Stripe, authorizes payment for the ordered or pre-ordered Products.
Cards accepted include Visa, Mastercard, American Express, Discover, Diners Club and JCB.
AXEPT reserves the right to suspend or cancel any Order or Pre-Order in the event of card payment refusal or non-payment. In particular, AXEPT reserves the right to refuse delivery of Products or to fulfill an Order or Pre-Order in the event that the Customer has not respected the payment of a previous Order or in the event of an ongoing dispute relating to a payment.
The Products remain the property of AXEPT until paid for in full. However, the Customer is responsible for the Products once delivered.
Orders and Pre-Orders are confirmed when the Customer clicks on the “Place Order” button.
By placing an Order or a Pre-Order, the Customer confirms that he accepts the GCS and the main characteristics of the Product(s) in question.
Upon receipt of an Order or Pre-Order, a confirmation email is sent to the Customer containing the details of the Order (Product/s, price/s, availability, quantity, etc.). To this end, the Customer agrees to receive an email confirming and summarizing the Order or Pre-Order. In any case, a paper invoice is included in all Orders.
In the event that the minimum target of a Pre-Order is not reached, AXEPT will inform the Customer at the end of the Pre-Order campaign that the Product will not be produced and the payment will be refunded.
The Products are shipped to the delivery address indicated by the Customer. This may be the residential address of the Customer or another person of his choice, provided that the details are correctly specified at the time of the Order or Pre-Order. The delivery address cannot be a hotel or a post office box.
The Customer must ensure that their personal data is correct and complete. In the event that the recipient's data is incorrect, AXEPT will not be responsible for the inability to deliver the Product(s).
Delivery times are indicated during the Order or Pre-Order process. These are approximate, expressed in working days and represent the average processing and delivery time.
The Customer acknowledges that, in the case of Pre-Orders, delivery times will be longer. Estimated delivery times are indicated in the product information at the time of purchase and in the Order or Pre-Order confirmation email. For Pre-Orders, delivery times depend on the time needed to produce the Product(s), as well as the quantity of items to be produced.
AXEPT cannot be held responsible for delays in delivery caused by circumstances beyond its control or by force majeure events.
The Products are considered delivered when they are delivered to the Customer by the courier, as registered in the latter's system.
Upon receiving the Products, the Customer must check the conditions of the packaging and report any damage caused by the courier on the delivery document, as well as inform AXEPT within three (3) days of delivery by sending an email to [insert email address] or using the contact form on the Site. The Customer expressly accepts the Products upon delivery.
The Customer may request that the invoice be sent to the billing address instead of the delivery address.
Delivery costs are borne by the Customer, regardless of the country of delivery. Return costs are covered by AXEPT only if the Customer exercises the right of withdrawal or in the event of non-compliance, except when the delivery address is outside of Italy. In this case, international return costs will only be covered in the event of non-conformity of the Product.
AXEPT is responsible for any lack of conformity existing at the time of delivery of the Product, in accordance with the conditions set out in articles 128 et seq. of the Italian Consumer Code.
The Customer who wishes to invoke the legal guarantee of conformity should bear in mind that:
You have two years from delivery of the Product to take action.
You can choose between repairing or replacing the Product, unless one of these options is impossible or excessively burdensome for AXEPT compared to the other.
You are not required to provide proof of the lack of conformity of the Product for twenty-four months from delivery.
This legal guarantee of conformity applies regardless of any commercial guarantee offered.
The Customer may decide to make use of the guarantee for hidden defects, pursuant to article 1490 of the Italian Civil Code, for Products sold which make them unsuitable for use or significantly reduce their value. In this case, the Customer can choose between terminating the contract or a price reduction, in accordance with article 1492 of the Italian Civil Code.
Pursuant to article 52 of the Italian Consumer Code, the Customer has the right to withdraw from the contract within fourteen (14) days of delivery of the Order, without the need to provide a reason.
The withdrawal period begins from the day the Customer receives the Product.
The Customer who exercises the right of withdrawal must attach a copy of the invoice or other document that includes the details of the Order and the Customer in question.
Only AXEPT Customers can exercise this right, excluding third parties and, in particular, recipients who are not Customers (as in the case of gifts).
Return and Refund Procedure
The Customer must inform AXEPT of his intention to return or exchange a Product using the contact form available on the Site. A copy of the withdrawal form is sent to the Customer with the Order.
The Products must be returned by the Customer within fourteen (14) days of the notice of withdrawal.
To make an exchange, obtain a refund or a voucher for the full value, the Customer must return the Product in the original or equivalent packaging and in perfect condition (re-saleable, unworn and unwashed).
If the Product is lost or damaged during the return, the Customer will be responsible.
Products not returned in the terms and conditions described above will not be refunded or replaced by AXEPT.
The Products must be returned to:
AXEPT S.R.L.
Via Vincenzo Capelli, 6,
20124 Milan, Italy
In compliance with article 56 of the Italian Consumer Code, AXEPT undertakes to reimburse the Customer within fourteen (14) days from the date on which the withdrawal notice was received or, if later, from the date of receipt of the returned Product.
The refund will be made to the credit or debit card used by the Customer for the purchase. If the Customer has changed bank, he must inform his old bank to ensure collection of the refund.
Electronic invoicing is the default method for purchases on the Site. In compliance with current legislation, the Customer will receive the invoice in electronic format to the email address provided.
Eligibility: The referral program is open to registered customers who have completed an Order. The referral code is personal and non-transferable, nor can it be posted on coupon sites.
Referral credit received is subject to the general terms and conditions set out above and cannot be exchanged for money or transferred.
To provide the services offered, AXEPT may process the personal data provided by the Customer at the time of registration or Order or Pre-Order on the Site.
The personal data collected will be used exclusively for processing the Order or Pre-Order, managing the commercial relationship, for statistical purposes and to improve the services offered. The data may be shared with partners who provide services on the Site or who allow AXEPT to fulfill Orders and Pre-Orders. The Customer has the right to access their personal data and can request rectification or opposition to their processing, in accordance with the Italian law on the protection of personal data. These GCS are governed by Italian law. In the event of a dispute or complaint, the Customer must first contact AXEPT to seek an amicable solution.
The Customer is informed that he can use alternative mediation services (ADR) to find a solution to a dispute with the assistance of a mediator.
For disputes with consumers, AXEPT offers the possibility of using ADR (Alternative Dispute Resolution) mediation services or via the European ODR platform for dispute resolution.
For non-consumer customers, any dispute will be under the exclusive jurisdiction of the court in the place of AXEPT's registered office.
If a clause of these GCS is declared void, the remaining clauses will remain valid.
AXEPT offers Customers the possibility of donating 1% of the amount of each purchase directly to a selected non-profit organization or charity association via a dedicated plug-in on the Site. The donation is automatically generated as part of the purchase and transferred directly to the chosen organization without passing through AXEPT.
AXEPT limits itself to providing the technical platform to facilitate the donation and does not manage or retain in any way the funds intended for the associations. The organizations available for donations are selected by the plugin, and AXEPT is not responsible for the management or final use of donated funds.
The Customer understands that 1% of the total purchase will automatically be donated to charitable purposes and that this operation cannot be separated from the purchase of the Products.
